Last week, the INDY reported that the SBI had completed its investigation into Frank Clark’s death at the hand of Durham Police Master Officer Charles Barkley and had referred the case to Durham County District Attorney Roger Echols. This morning, we learned from sources close to the investigation that Echols has decided not to prosecute Barkley. Then, moments ago, a formal announcement was made, via a statement from Echols that said there was not “probable cause” found by investigators to suggest foul play by Barkley—or warrant a prosecution. Here’s what he had to say.

Dave Hall, an attorney with the Southern Coalition for Social Justice and the Clark family’s attorney, told the INDY his office would release a statement after he has a chance to thoroughly review Echols’ report. We’ll keep you posted as more develops.
