Good morning, readers. 

In Wake County’s Judicial District 10D, judge Debra Ann Sasser, a Democrat who has served in office since 2005, is retiring once her current term ends in December. 

This opened the door to two Democrats who are running to succeed her: Blair Williams, Wake County’s clerk of Superior Court, and Kevin Boxberger, a criminal defense attorney. And since no Republicans have filed to run in November, the winner of that primary would automatically assume the 10D, Seat 5 spot. 

But then earlier this month, judge Ned Mangum, a Republican and formerly the chief justice of Wake County District Court, announced his immediate retirement, leaving his 10D, Seat 3 spot open in November. 

Since the district courts were made partisan once again in 2017, both the Wake County Democratic and Republican parties, under state law, nominated candidates to fill the seat. Republicans nominated attorney Karl Roth, and the Democrats nominated Boxberger. 

But there’s an issue: Boxberger can’t hold two seats. So if he wins the race against Williams for the Seat 5 spot, he’ll have to resign from that seat to run for the Seat 3 spot in November. 

That’s what he says he’ll do, and the Democrats expect to pick up two judge’s seats in Wake County this year. (Of course, if Williams wins the election in March, Boxberger is free to run in November).

“Even though none of us want partisan elections, all judicial elections matter,” says Wake County Democratic Party chair Kevyn Creech. “We’ve been diligently working for over two years to pick up as many district court seats as possible.”
